1. About this Agreement
This End User Licence Agreement ("EULA") governs your use of the Gettit mobile application (the "App"). It applies in addition to our Terms of Service and our Privacy Policy. If there is any inconsistency about your use of the App, this EULA applies to the App-specific matters, and the Terms of Service apply to everything else.
By installing, accessing or using the App, you accept this EULA. If you do not accept it, please do not install or use the App.
2. Licence
Gettit grants you a personal, limited, non-exclusive, non-transferable, non-sublicensable and revocable licence to download and use the App on a device you own or control, solely for your own use of the Gettit marketplace, and in accordance with this EULA and our Terms of Service. This is a licence, not a sale, and Gettit reserves all rights not expressly granted to you.
3. What you may not do
To the extent permitted by law, you must not:
- copy, modify, translate or create derivative works of the App, except as the law allows;
- reverse engineer, decompile or disassemble the App, or attempt to derive its source code, except to the extent this restriction is prohibited by law, including section 47D of the Copyright Act 1968 (Cth) where it applies;
- rent, lease, lend, sell, sublicense, distribute or otherwise make the App available to anyone else;
- remove, obscure or alter any proprietary notice in the App;
- use the App to build or assist in building a competing product or service;
- circumvent, disable or interfere with any security, authentication or rate-limiting feature of the App; or
- use the App in any unlawful way, or in any way that breaches our Terms of Service or Community Guidelines.
4. Objectionable content and abusive behaviour
Gettit has zero tolerance for objectionable content and for abusive users. By using the App you agree that you will not create, upload, post, send or share content that is unlawful, harassing, bullying, hateful, discriminatory, threatening, violent, sexually explicit, defamatory, misleading or deceptive, or that exploits or endangers a child; and that you will not harass, threaten, abuse, stalk, impersonate or otherwise mistreat another user.
You can report objectionable content at any time: open the listing and tap "Report this listing". You can block an abusive user from their profile by tapping "Block this user", and manage everyone you have blocked under You, then Blocked users. We review every report and act on it.
If you post objectionable content or behave abusively, we may remove the content, suspend your access, or permanently terminate your account, without notice and at our discretion.
5. Ownership and intellectual property
The App, and all intellectual property rights in it, including its software, design, text, graphics and the Gettit name and logos, are owned by Gettit Pty Ltd or its licensors. This EULA grants you a licence to use the App. It does not transfer any ownership to you. You must not use the Gettit name, logos or branding except as we expressly permit.
6. Third-party and open-source components
The App may include third-party or open-source software components that are licensed under their own terms. Where a component's licence grants you rights that are broader than, or conflict with, this EULA, that licence applies to that component. A list of relevant components and their licences is available on request at help@gettit.com.au.
7. Updates
We may release updates, upgrades, patches and new versions of the App. Some updates may be necessary for the App to keep working safely or at all, and over-the-air updates may be delivered automatically through your device or app store. This EULA applies to any updated version, unless the update is accompanied by separate terms, in which case those terms apply to that update.
8. App store terms
If you download the App from the Apple App Store or Google Play, your use is also subject to that store's terms.
- You acknowledge that this EULA is between you and Gettit, not with Apple or Google, and that Gettit, not the store provider, is responsible for the App.
- The store provider has no obligation to provide support or maintenance for the App.
- To the extent permitted by law, the store provider is not responsible for any claim relating to the App, including product liability, any failure to meet a legal or regulatory requirement, or a claim under consumer protection law, except as required by the ACL or other law that cannot be excluded.
- You confirm that you are not located in a country subject to a relevant trade embargo, and are not on a relevant prohibited-parties list.
- Apple and Google, and their subsidiaries, are third-party beneficiaries of this EULA to the extent it relates to their store, and may enforce it as such.
9. Privacy
The App handles personal information as described in our Privacy Policy, including how location is collected and why your precise location is never exposed to other members. Please read the Privacy Policy so you understand how your information is handled.
10. Your statutory rights and disclaimers
The App is provided on a reasonable-efforts basis. To the extent permitted by law, we do not warrant that the App will be uninterrupted, error-free or compatible with every device.
Nothing in this EULA excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded. Where the law allows us to limit our liability, our liability in connection with the App is limited as set out in our Terms of Service, and, for a consumer guarantee that can be limited, is limited at our option to supplying the App or the relevant service again, or paying the cost of doing so.
11. Termination
This licence ends automatically if you stop using and remove the App, if you breach this EULA or the Terms of Service, or if Gettit ceases to offer the App. On termination, you must stop using the App and remove it from your devices. Provisions that by their nature should continue, including clauses 3, 4, 9 and 11, survive termination.
12. General
- Governing law. This EULA is governed by the laws of the State of Victoria, Australia, and you and Gettit submit to the non-exclusive jurisdiction of the courts of Victoria and the Commonwealth of Australia.
- Severance. If any provision is found to be void or unenforceable, it is to be read down or severed, and the rest of this EULA continues to apply.
- Changes. We may update this EULA from time to time. If a change is material, we will take reasonable steps to notify you, and your continued use of the App after the change takes effect means you accept the updated EULA.
